Before you guarantee someone else’s loan
A Hong Kong guarantor may have to pay if the borrower does not. Do not sign because of a relationship or a sentence that says you will not be pursued. This site provides no guarantee template.
A guarantee is your own risk
A guarantor is not a witness. If the borrower does not pay as agreed, the guarantor may be liable under the guarantee for principal, interest, fees, and enforcement costs. “Just sign to help, they will not chase the guarantor” is not protection when the document says otherwise.
These articles do not supply a guarantee form, and they do not suggest you sign so that someone else’s enquiry looks better. Whether a guarantee is required depends on that assessment and on writing. Before writing exists, there is no reason you must already guarantee anything.
Assume the borrower pays nothing
Before you sign, assume the borrower pays nothing, then ask whether you can meet the amount in the document. If you cannot, do not sign. Pressure from family, an employer, or a partner does not shrink the possible debt.
Look at your own mortgage, cards, and household costs. After you guarantee, that obligation may also be counted if you later apply for credit yourself. Signing is not the end of your involvement.
A personal guarantee and a charge over a flat are different
Some people sign a personal guarantee. Others are asked to charge their own flat. The second puts a home into the loan and is more serious. A jointly owned flat may need the other owners as well. Do not sign without reading the title of the document.
A parent’s flat, or a spouse’s flat, should not secure a loan you do not fully understand. Read the page about a parent’s home, and each person should take independent legal advice.
You can refuse, and you should not be rushed
You should have time to read. Withholding the papers, refusing to let you take them away, or saying the quota dies today, is pressure rather than a duty. You can refuse. Refusal should not turn into a fee paid to a broker for a different story.
The borrower should not sign for you, and should not give you only the last page. Do not sign a blank. Keep a complete copy if you do sign.
After signature, the document governs
A guarantee that has been validly signed is not cancelled by a later conversation. Repayment and release follow the document. If the borrower says it is cleared, ask to see the lender’s writing, not only the borrower’s word.
Do not pay a personal account because someone posing as staff demands a “release fee” from the guarantor. Call 3622 2934 and ask whether that loan is with this firm. You have to repay your loans. Don’t pay any intermediaries.
